Self-managed superannuation funds (SMSF’s) have become a very popular means of providing for income in retirement. A large proportion of Australia’s retirement savings are now held in these investment structures.

SMSF’s can have significant advantages for retirement and estate planning, whilst allowing direct control over investment decisions. However, the legislation governing SMSF’s is complex, and Trustees have considerably onerous obligations and duties placed upon them. In particular, they need to understand the types of assets and investments which are permitted. There are also restrictions on when and under what circumstances money can be withdrawn from a Fund. Furthermore, all SMSF’s (regardless of size) must be audited before lodging their income tax return each year.
